If your lender has violated provisions of the ordinance, as listed below, for loans after January 1, 2013, you may file a complaint.
Ordinance Provisions
- Credit Access Business does not have a current valid certificate of registration from the City of San Antonio.
- Provided payday loans greater than 20% of the borrower’s gross monthly income or more than 70% of the vehicle value.
- Provided auto title loans that are more than 3% of the borrower’s gross annual income or more than 70% of the vehicle value.
- Provided loans greater than four installments or three rollovers or renewals (a rollover or renewal is defined as an extension of consumer credit made within seven days of the previous extension of credit).
- Provided installments or renewals which did not reduce the loan principal by 25%.
- Did not provide a contract written in a language the borrower could understand.
- Did not read contract in its entirety to any borrower who cannot read.
- Did not provide to the borrower information on non-profit agencies that provide financial education and agencies with cash assistance programs and general information regarding extensions of consumer credit.
