Encroachment Permits

City of San Antonio Real Estate did not have a system in place to track expired Ordinances/License Agreements for renewals prior to 2022. As of 2016, the City issues permits in lieu of Ordinances/License Agreements to avoid having to obtain City Council approval for each public right of way encroachment.

Definitions

Permit

A permit is an instrument granting approval for encroachments into city right of way or drainage easements.

Encroachment

Encroachments are defined as any physical obstruction or any structure or object of any kind or character placed either in, under, or over any city street, alley or drainage easement in which the city has an interest.

Public Right of Way

Public right of way means any easement or fee over which the public has a right to pass, such as public streets, roads, lanes, paths, alleys, and sidewalks, whether improved or unimproved.

Petition Process

Fees

  • Encroachment Permits (onto city right of way): $500
  • Processing fee: $500

NOTE: Fees for processing requests are non-refundable and are in accordance with Chapter 37-22 of the Municipal Code. See this section for additional consideration amounts associated with these processing fees and transactions.

Submit

Submit completed application and check or money order for the $500 non-refundable processing fee, made payable to the City of San Antonio. Petitions are processed only upon a complete submission of the petition package and processing fee.

Permit Renewal

If the property owner/petitioner chooses not to continue with the renewal process, they will be asked to remove the public right of way encroachment at their own cost. If the property owner/petitioner chooses to not remove the encroachment, Code Compliance will be notified, and the property owner/petitioner may be subject to fines.

Renewal Process

  1. Property owner or petitioner will complete the petition and return it, along with the $500 processing fee and $500 permit fee, to the City of San Antonio Capital Delivery (CDD) Real Estate Division.
  2. Upon receipt, the Real Estate Division will draft a new permit for the existing right of way encroachment.
  3. The permit will then be reviewed and approved by the Real Estate Manager and City Attorney.
  4. Once approved, the permit will be sent to the property owner or petitioner for execution.
  5. After the original executed permit is returned to the Real Estate Division, it will be filed with Bexar County and then sent to the property owner or petitioner.
