D10 Councilman Reacts to City’s Intended Lawsuit Regarding House Bill

SAN ANTONIO (July 24, 2023) – Today the City of San Antonio announced it joined a lawsuit filed by the City of Houston against the State of Texas  to invalidate the Texas Regulatory Consistency Act (the “Act”), also known as House Bill 2127. The bill was passed by the Texas legislature and signed into law by Governor Abbott on June 13, 2023 and is scheduled to take effect September 1, 2023. 

“This decision is short-sighted and ignores the needs of businesses in San Antonio and around Texas,” said District 10 Councilman Marc Whyte. “The Regulatory Consistency Act was written to prevent businesses in Texas from having to comply with a patchwork of different laws in each jurisdiction where they do business. The Act will keep city governments focused on city issues rather than trying to legislate on issues that the state regulates.”

This new law has been widely praised by business groups around Texas such as the Texas Association of Business and our San Antonio Hispanic Chamber of Commerce.

The District 10 Councilman added, “We need to focus on issues we were elected to address such as homelessness, rising crime and the maintain our streets and sidewalks. These were top issues in a recent citizen survey of concerns. Lawsuits like the one announced today do nothing to help relationships with our other government entities such as the State, regardless of the outcome. It is my hope that moving forward, we all will have a chance to forge better relationships with these government entities, while staying focused on doing the work our neighbors here in San Antonio elected us to do.”
