District 10 Councilman Votes Against Proposed Data Center Restrictions

SAN ANTONIO (October 29, 2026) – Councilman Marc Whyte voted against the proposed data center restrictions approved by Council, stating the measure goes further than necessary and does not create a standard for businesses to rely on.
“I support tough regulations on data centers, including keeping them away from neighborhoods, schools, and our drinking water. Our city deserves those protections,” said the District 10 Councilman. “However, this does not establish a standard and instead creates uncertainty for businesses on whether or not they are welcome in our city.”
Before the final vote, the District 10 Councilman moved to amend the ordinance to match the Zoning Commission’s recommendation, which he said struck the right balance between protecting neighborhoods and giving businesses certainty. The motion failed, and the District 10 Councilman voted against the final item.
“The Zoning Commission got this right,” said the District 10 Councilman. “Their recommendation protected residents and gave companies a clear rule to follow. The version Council passed is an overreach, and I couldn’t support it.”
The District 10 Councilman assured that San Antonio remains open to businesses ready to invest here and meet the City’s standards. “Companies that maintain a high standard are welcome in San Antonio,” he said. “We can protect our neighborhoods and still keep the jobs and investment our community needs.”
The District 10 Councilman said he will keep working with his Council colleagues, City Staff, and the community on data center standards that keep residents safe and give companies a clear path to build in San Antonio.
